These Terms and Conditions apply to all users of the platform, including those who subscribe, use our services, or just browse. It also outlines your rights as a data subject under the GDPR and other relevant data protection laws.

Definitions:

• Any individual or entity that accesses or uses the website, or interacts with the services provided by HighSeek Tech Limited in any way, is considered a user.

• Platform: The website or online platform through which HighSeek Tech Limited offers its services.
• Geographical Scope: The website operates within Europe, with its primary customer base located in Europe.

Eligibility for User:

By using and accessing the platform, you acknowledge, affirm, and agree to the following:

Types of Membership & Subscription Details:

Membership Types

• The company provides its services through different types of membership. There are one-off payment memberships such as Basic and Pro, and there are also paid membership subscriptions, which are offered on either a biweekly (Advanced) or monthly basis (Growth). By registering to the platform or utilizing its services, you consent to these ongoing payments.

Trial Period and Automatic Renewal for Membership Subscription

• Your subscription membership may begin with a trial period, with details available in the pricing table. During registration, payment details are required, and a small test charge may be processed and refunded.
• Unless canceled within the trial period, the subscription membership automatically transitions into a recurring subscription at the standard rate, as shown in the "Pricing by Country" section.
• The subscription renews at the end of each subscription period unless cancelled before the renewal date. Members can check the trial’s end date in their account settings.

Pricing and Access

     The platform operates on a paid-access model, offering the following plans:

• Efforcie Bi Weekly for a 14-day subscription
• Efforcie Monthly for a 30-day subscription

     Any membership grants unlimited access to the website’s premium features.

Account Registration and Payment Terms

• Upon registration, members must complete their profiles by providing the required information.
• Before payment is processed, members are clearly informed about pricing, service scope, and applicable terms. Once payment is confirmed, premium features become accessible.

Payment Methods:

• You can make payments online using Visa, Mastercard, or other alternative payment methods available. The payment options will be shown to you during the payment process, based on your location and membership history, as determined by our Payment Service Provider.
• All credit card transactions are securely processed.
• Please be aware that some payment methods may incur additional charges, such as foreign transaction fees. We recommend verifying any such fees with your payment method provider.
• Once you're a member, you can view and update your payment methods in your Account Settings. We may also update your payment details using information provided by our payment service providers, such as when your card expires.

Periodic Subscriptions are Automatically Recurring:

• For subscription payment methods, you may be automatically charged around 24 hours before your new month begins.
• If your recurring payment is unsuccessful, our payment providers will retry your payment method. If after weeks we still have not successfully charged your payment method, your access to the site will be revoked.

Pricing by Country:

• The pricing for memberships and services may vary based on the user's country of residence. The company reserves the right to set different prices for users in different countries, depending on regional factors such as local taxes, currency fluctuations, and other market conditions.
• All prices displayed on the website are in the relevant currency for the user's location and will be clearly indicated during the subscription process. By registering or subscribing to any services, you agree to the pricing applicable to your country and are responsible for any additional charges that may apply, such as taxes or fees.

Cancellation of Subscription:

You can cancel your subscription at any time through your account settings. Please be aware that recurring payments are processed at least 24 hours prior to the end of your subscription period. You will retain access to Efforcie platform until the conclusion of your current subscription period. For further information, please refer to our payment page link. Changes to the subscription price:

We may change the price of our subscriptions. However, we will notify you in advance, and any price changes or changes to your subscription plans will only apply to subsequent billing cycles.

Accuracy of Information:

The website may contain errors or inaccuracies, including in promotions and offers. We reserve the right to correct any mistakes, update information, or cancel services without prior notice. We are not obligated to update or clarify information unless required by law, and a refresh date does not imply that all information is up to date, neither does the lack of a refresh date imply that all information is not up to date.

Third-party services:

• If you choose to access or use third-party services through hyperlinks, payment methods, or other means, please note that their terms and conditions solely govern your use of these services.
• We do not endorse, accept responsibility for, or make any representations regarding these services, including their content, data handling practices (including your data), or any interactions between you and the service provider.

Accessing website videos for any purpose or in any manner other than streaming is expressly prohibited.

• In no event shall the company be liable for any damages whatsoever resulting from the statements or conduct of any third party or the interruption, suspension, or termination of any services, whether such interruption, suspension, or termination was justified or not, negligent or intentional, inadvertent or advertent.

Indemnity:

Governing Law & Dispute resolution:

• If the dispute remains unresolved after 30 days, the parties agree to submit the matter to arbitration in accordance with the Arbitration Rules. The arbitrator will be selected by the Company. The seat of arbitration will be Hong Kong, and the arbitration will be conducted in the English language.
• These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Hong Kong. You consent to the exclusive jurisdiction of the courts in Hong Kong, for any legal action or proceeding.
• The venue for dispute resolution will be the location solemnly decided by the company.
• You waive your right to participate in any class action or judicial proceedings. Instead, you agree to resolve any disputes directly with the company. If the issue remains unresolved, it will be settled through arbitration.

Disclaimer of Warranties:

• The company has endeavored to ensure that all the information on the platform is correct, but the company neither warrants nor makes any representations regarding the quality, accuracy, or completeness of any data, information, or platform services.
• The Company shall not be responsible for the delay or inability to use the Platform or related functionalities, the provision of or failure to provide functionalities, or for any information, software, functionalities, and related graphics obtained through the Platform or otherwise arising out of the use of the Platform, whether based on contract, tort, negligence, strict liability, or otherwise.

License Grant:

• In the event of termination, the company will not refund any fees paid before the termination, and you will remain obligated to pay any fees or charges accrued prior to the termination.

• Any content found to be in direct violation of the law or involving harassment will be reported to the relevant authorities, including the IP address of the member, the time of creation, and any other necessary information.

Anti-Money Laundering (AML) Policy:

• The company follows UK and Europe laws to prevent money laundering and financial crime. Users must provide valid identification, and failure to do so may result in account suspension or termination.
• Transactions are monitored, and suspicious activity will be reported to authorities. The company keeps records for five (5) years and may share them with regulators if required.
• Users must not engage in illegal financial activities or provide false information. The company may suspend accounts, freeze funds, or take legal action if violations occur.

Entire Agreement:

These Terms, along with our Privacy policy and any other legal notices or agreements published by us, constitute the entire agreement between you and the company regarding the use of the platform and services.
